Terms of Service

Please read these Terms of Service ("Terms") carefully before using the HiredTrade platform operated by SavicNode ("we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part, you may not access the service.
1. Acceptance of Terms
By creating an account or using HiredTrade in any way, you confirm that you are at least 18 years old, have the legal capacity to enter into binding contracts, and agree to these Terms and our Privacy Policy.
These Terms constitute the entire agreement between you and SavicNode regarding the use of the HiredTrade platform and supersede all prior agreements.
2. Description of Service
HiredTrade is a SaaS (Software as a Service) platform designed for home service and trade businesses. The platform provides tools for scheduling appointments, managing customers, collecting deposits, optimizing field routes, processing payments, sending automated reminders, generating invoices, and analyzing business performance.
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
3. User Accounts
You must register for an account to access most features of HiredTrade. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to:
- Provide accurate, current, and complete information during registration
- Promptly update your account information to keep it accurate
- Immediately notify us of any unauthorized use of your account
- Not share your credentials with any third party
- Not create more than one account per business entity without our written permission
We reserve the right to terminate or suspend accounts that violate these Terms or for any other reason at our sole discretion.
4. Subscription Plans and Billing
HiredTrade offers subscription-based plans (Starter, Professional, and Enterprise). Plan details, features, and pricing are described on our pricing page and are subject to change with 30 days' notice.
Billing Cycle: Subscriptions are billed monthly or annually in advance depending on your selected plan. Your subscription renews automatically at the end of each billing period unless cancelled.
Free Trial: New accounts may be eligible for a 14-day free trial. At the end of the trial, you will be charged unless you cancel before the trial period ends.
Refunds: Subscription fees are non-refundable except as required by applicable law or as expressly stated in our refund policy. Unused portions of a billing cycle are not refunded upon cancellation.
5. Payment Processing (Stripe)
All payment processing on HiredTrade is handled by Stripe, Inc., a third-party payment processor. By using payment features, you agree to Stripe's Terms of Service and Privacy Policy.
SavicNode does not store full credit card numbers or sensitive payment data on its servers. Payment information is transmitted directly to Stripe using industry-standard TLS encryption. You authorize us to instruct Stripe to charge your payment method for subscription fees and any applicable taxes.
For businesses using HiredTrade to collect deposits from their own customers, you are responsible for compliance with applicable payment card industry (PCI) standards and for the accuracy of all charges made through the platform.
6. Email Communications (SendGrid)
HiredTrade uses Twilio SendGrid to deliver transactional and notification emails, including account confirmations, booking confirmations, invoices, and automated reminders.
By creating an account, you consent to receive transactional emails necessary for the operation of the service. You may opt out of non-essential marketing emails at any time via the unsubscribe link in any email or through your account settings. Opting out of transactional emails (e.g., invoice delivery) may impact your ability to use certain features.
7. SMS Communications (Twilio)
HiredTrade uses Twilio to send SMS messages, including appointment reminders, booking confirmations, and other service notifications, to you and your customers (with their consent).
By providing a mobile phone number and enabling SMS notifications, you consent to receive automated text messages from HiredTrade. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any SMS message or adjusting your notification settings. For help, reply HELP or contact us at support@hiredtrade.com.
You are responsible for obtaining proper consent from your own customers before enabling SMS notifications on their behalf through the platform.
8. Platform Fee on Processed Payments
HiredTrade charges a flat 5% platform fee on every customer payment processed through the Service, including (without limitation) booking deposits, remaining balance payments, invoice payments, and estimate-linked deposits. This fee is separate from and in addition to your subscription fee.
The platform fee covers third-party payment processing costs (currently Stripe's 2.9% + $0.30 per charge) as well as the infrastructure required to accept, route, and reconcile those payments on your behalf. The fee is deducted from the gross amount collected from your customer before that amount is credited or remitted to your account.
Each booking, invoice, and estimate in your dashboard displays the exact platform fee applied and the net amount attributable to your business. We will give you at least thirty (30) days' written notice (via email or in-app notification) before any change to the platform-fee percentage. Continued use of the Service after the effective date constitutes acceptance of the new rate.
Payments are processed via Stripe Connect. When you complete Stripe Connect onboarding, customer payments collected through the Service are routed by Stripe directly to the Stripe account you connect, minus the platform fee described above. Stripe is the payment processor of record; your relationship with Stripe is governed by the Stripe Connected Account Agreement. Until you complete Stripe Connect onboarding, HiredTrade may temporarily hold funds collected on your behalf; those funds will be transferred to you once onboarding is complete. Refunds on Connect-routed payments are reversed from the connected account's balance.
9. Data Collection and Privacy
We collect personal information as described in our Privacy Policy. This includes information you provide directly (name, email, phone, business details) as well as usage data collected automatically.
You retain ownership of your business data (customer records, bookings, etc.) stored on HiredTrade. We process this data on your behalf and will not sell it to third parties. See our Privacy Policy for complete details.
10. Acceptable Use
You agree not to use HiredTrade to:
- Violate any applicable laws or regulations
- Send unsolicited bulk communications (spam) to your customers
- Collect payments for fraudulent, illegal, or deceptive services
- Upload, transmit, or store malicious code or content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Scrape, harvest, or extract data from the platform in an unauthorized manner
- Resell or sublicense access to the platform without our express written consent
- Impersonate SavicNode or any employee, agent, or other user
11. User Content
You retain all rights to the content you upload or create on HiredTrade (e.g., business information, customer data, notes). By submitting content, you grant SavicNode a limited, non-exclusive, royalty-free license to store, process, and display that content solely to provide the service to you.
You are solely responsible for the accuracy and legality of content you upload and for ensuring you have the right to share any personal information about your customers with us.
12. Intellectual Property
The HiredTrade platform, including its design, code, trademarks, logos, and content created by SavicNode, is our exclusive property and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for your internal business purposes.
You may not copy, modify, distribute, sell, or create derivative works of the platform or any part thereof without our prior written consent.
13. Third-Party Services and Integrations
HiredTrade integrates with third-party services including but not limited to Stripe (payments), Twilio SendGrid (email), and Twilio (SMS). Your use of these integrations is governed by the respective third-party terms. We are not responsible for the practices, availability, or content of third-party services.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SAVICNODE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that the service will meet your specific requirements or that any errors will be corrected. Use of the service is at your own risk.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAVICNODE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
16. Indemnification
You agree to defend, indemnify, and hold harmless SavicNode and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the service, your violation of these Terms, or your violation of any rights of a third party, including your customers.
17. Termination
Either party may terminate the agreement at any time. You may cancel your subscription through your account settings. We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or if required by law.
Upon termination, your right to access the service ceases immediately. We will retain your data for 30 days post-termination to allow for export, after which it may be deleted. Provisions that by their nature should survive termination (including intellectual property, disclaimer, limitation of liability, and indemnification) will continue to apply.
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which SavicNode is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
19. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
